Annual Dues

The Annual Assessment

The purpose of the Maintenance Corporation is to maintain the common grounds in good and proper condition, fit for their intended purposes, and according to the New Castle County Code and our Maintenance Declaration. This includes such things as landscaping the common grounds, maintaining playgrounds and equipment, maintaining the two ponds in the development, providing snow removal, and providing insurance.  (The complete Maintenance Declaration can be found in the Legal Documents section of this website.)

The Estates of Red Lion Annual Assessment for each home is $150.00 and is due on March 1st of each year. The assessment has remained at $150.00 since we took over the Maintenance Corporation responsibilities in 2006.

The Invoicing and Collection Process

The annual billing and collection process is as follows:

  • Invoicing - In the last week of January each year an invoice for the current year's assessment will be sent to every homeowner of record. It will indicate the due date of March 1st and reflect the amount of that year's assessment.

  • Overdue Notice - Homeowners who have not paid by the Due date (March 1st) shall be sent an overdue notice by Mid-March advising them of their delinquency.

  • Interest Charges - Homeowners who have not paid by April 1st shall be charged interest at the then legal rate from March 1st until the entire balance is cleared. We currently charge 1% per month.

  • Legal Actions - The Maintenance Corporation may begin legal action after April 1st to begin the process of collection and/or the placing of a lien on the delinquent homeowner's property. All legal fees incurred by EORL plus interest will be added to the homeowner's original assessment.

  • Legal Actions Required - Assessments not received by May 1st will automatically and immediately have legal action brought against them for collection of unpaid amounts. All legal fees, court costs and registering of property lien documents will be added to the homeowner's original assessment and continue to accumulate interest charges until paid in full.

NOTE: Legal Fees incurred by ERL Maintenance Corp. for the collection of unpaid assessments cannot be cancelled and will remain the homeowner's responsibility.
